IDEAL DRIVING SERVICE TERMS & CONDITIONS

Please read the Terms and Conditions before using the website and services offered by Ideal Driving Service LLC.® (“IDS”). This agreement sets forth the legally binding terms and conditions for your use of the website idealdrivingservice.com and the service provided by IDS.

IDS is the owner and operator of idealdrivingservice.com and reserves the right to modify the Terms and Conditions or its policies relating to the website at any time.

IDS does not employ drivers or provide vehicles for transportation. IDS is an alternative means of providing transportation. The passenger will be driven in the comfort of their own vehicle by our drivers, who are independent contractors that are not employed by IDS. We run background checks on our drivers along with checking our drivers’ DMV driver report history to ensure the comfort and safety of our clients. You hereby acknowledge that each driver to whom you are assigned is an independent contractor and not an employee of IDS.

Disclaimer and Release

IDS is a service by which our driver will drive the passenger’s vehicle to get to the desired destination. You acknowledge that our service does not provide its own transportation vehicles and instead uses the passenger’s vehicle for its services. You also agree to let the driver access your vehicle and keys for the sole purpose of reaching your desired destination. You also agree to let IDS retain the keys as necessary if the driver needs to use the car to complete a trip.

You expressly understand and agree that your use of the services and the website is at your sole risk. You are willing to personally bear any risks related to your use of the services, assuming full responsibility for any harm or damage that may result. As a passenger, you acknowledge that in exchange of using the services, you hereby: A) release IDS for any injury, including death or property damage that may occur in connection with its services, and B) agree not to initiate legal proceedings against IDS with respect to any such claims for damages.

Passenger Agreements

Any passenger using IDS and its services hereby agrees to:

·         Allow drivers to drive their vehicles for the purposes set forth in these terms;

·         The driver’s use of the vehicle is covered under the passenger’s insurance policy;

·         Obey all civil and criminal laws, including but not limited to seat belt and open container laws;

·         Avoid all unnecessary and/or inappropriate physical contact with the drivers before, during, and after the pick-up, transport, and drop-off;

·         Pay any expenses required to get the vehicle safely to its destination, including but not limited to: A) fuel costs If any; B) tolls; and C) parking fees;

·         Allow IDS or any driver to leave the vehicle locked and parked in the hospital or urgent care parking lot in the event of a medical emergency.

Passenger Vehicle Requirements

Any passenger using IDS agrees that as of each date on which you request IDS services:

·         The vehicle to be operated has been registered;

·         Passenger is the rightful owner or lessee of the vehicle;

·         The vehicle’s registration and insurance are current, a copy of the registration and insurance certificate will be in the vehicle, and the vehicle is covered by a fully comprehensive insurance policy under which the drivers are covered;

·         The vehicle is maintained in good working condition and has no defects or conditions that may cause the vehicle to be unfit or unsafe to drive;

·         No contraband, substance, or other items that are illegal for public transport are within the vehicle (including, but not limited to firearms, explosives, alcohol, and drugs or drug paraphernalia); and

·         The passenger vehicle will have sufficient fuel to reach the designated location.

Payment

IDS shall charge you for the transportation services provided to you by the driver on behalf of the driver once the trip has concluded. You agree that you will pay for all transportation services you purchase, and that IDS may charge your credit card account as provided by you when services are complete. IDS uses a third-party payment processor to charge your credit card account. The processing of payments or credits will be subject to the terms, conditions, and privacy policies of the payment processer and your credit card issuer in addition to these terms. IDS is not responsible for any errors caused by the payment processor.

Cancellation

A $50.00 cancellation fee will apply to trips that are cancelled less than 24 hours before the scheduled trip. This does not apply in situations where a scheduled flight was delayed or cancelled.

Refund Policy

All payments for services are non-refundable.

Website Policies & Agreements

Please read the other policies on our website, such as the Privacy Policy. When using IDS and its services, you agree to the terms listed and hereby affirm that you are of sound mind and body to enter and understand these terms as they are listed. You hereby waive any defense to the enforceability of these terms, including intoxication.
